When parents divorce, a parenting plan must be put in place. The parenting plan is a detailed document which sets forth a residential schedule for day to day responsibilities, vacations and holidays as well as information regarding decision making, health, dental and life insurance and income tax. Either the parties will agree to every aspect of this parenting, or the judge will make the decision for the parties.
In the state of Tennessee, child support payments are determined by the Child Support Guidelines. The guidelines set forth a formula that uses different factors to calculate child support. A worksheet must be printed which sets forth the child support amount, and this worksheet is then attached to the parenting plan. The worksheet takes into account many factors such as income, time with the children, health insurance and child care payments. Each factor affects the outcome.
In cases not involving children, the parties will either agree to the division of property and debts or again, the judge will decide. Don’t fight over the blender. Remember that most items can be replaced. It does not make sense to spend a thousand dollars to fight over the $25 blender Grandma Jones gave you as a wedding present.
Agreed upon uncontested divorces cost less money, period. In order for a divorce to be agreed upon, agreement must be reached on EVERY single item. This includes every section of the parenting plan and child support. If every item is agreed upon, and the divorce is uncontested, your divorce will be completed much more quickly.
There is life after divorce, and the best revenge you can have is to live well. I often recommend parties try mediation before paying retainers to attorneys for contested divorce issues. I am a certified Rule 31 mediator, and my office will be glad to discuss any family law matter with you.
